1. Introduction

Welcome to Nomadezy ("we," "our," or "us"). By accessing or using our mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

These Terms govern your use of Nomadezy and the services we offer. If you do not agree with any part of these Terms, you may not use our App.

2. Account Registration

2.1 Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

3. User Content

3.1 Your License to Us

By submitting content to the App (including profile information), you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display that content in connection with the services we provide to you and the operation of our business.

3.2 Prohibited Content

You agree not to submit content that:

• Infringes on the intellectual property rights of others
• Is unlawful, defamatory, obscene, pornographic, invasive of privacy, or objectionable
• Contains viruses, malware, or other harmful code
• Involves commercial solicitation or spam

4. Permitted Use and Restrictions

4.1 Permitted Use

You may use the App for personal, non-commercial purposes to research destinations, explore visa information, and plan your travels as a digital nomad.

4.2 Restrictions

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or our systems
• Scrape, data mine, or otherwise extract data from the App
• Modify, adapt, or hack the App or modify another website to imply association with the App
• Use the App in any way that could disable, overburden, or impair it

5. Subscription and Payments

5.1 Trial Period

We may offer a trial period to new users. You will not be charged during the trial period, but will be automatically enrolled in a paid subscription upon its conclusion unless you cancel beforehand.

5.2 Subscription Terms

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You authorize us to charge your payment method for the subscription fee plus any applicable taxes.

5.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will be effective at the end of your current billing period.

5.4 No Refunds

Payments are non-refundable except where required by law. We do not provide refunds or credits for partial subscription periods or unused services.

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its content, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

6.2 License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purposes subject to these Terms.

7. Disclaimers

7.1 Information Accuracy

While we strive to provide accurate information about destinations, visa requirements, and other travel-related matters, we cannot guarantee its accuracy, completeness, or reliability. You should always verify critical information with official sources.

7.2 No Travel Agency

We are not a travel agency or visa processing service. Our App provides information to assist with your planning, but we do not book travel arrangements or process visa applications.

7.3 General Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nomadezy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the new Terms on the App with a new effective date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the United States, without regard to its conflict of law provisions. You agree that any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may assert claims in small claims court if your claims qualify.

12. General Provisions

12.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

12.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
